Fair Use Policy

Aancall reserves the right to modify this Fair Use Policy (“FUP”) at any time. Updates become effective immediately upon posting the revised policy on our website. This policy applies exclusively to Aancall’s customers within the United States.
  


Users are prohibited from engaging in, enabling, or assisting others in the following activities:


General Prohibitions

  • Using Services in ways that expose Aancall or its partners to legal liability or regulatory action.

  • Violating applicable laws or regulations.

Security & Reliability

  • Circumventing security measures or compromising the safety of Aancall, Users, or third parties.

  • Unauthorized testing, reverse-engineering, or exploiting vulnerabilities in the Services.

  • Disrupting the stability, availability, or performance of Services or third-party networks.

  • Using Services in hazardous environments (e.g., nuclear facilities, air traffic control) where failure could risk injury or death.

Protecting Individual Rights

  • Spamming, unsolicited communications, or violating anti-spam/privacy laws (e.g., TCPA, CAN-SPAM, Do-Not-Call).

  • Collecting personal data (e.g., emails, phone numbers) without explicit consent.

  • Impersonation, deceptive practices, or bypassing identification systems.

  • Failing to obtain legally required consent for data collection, use, or disclosure.

  • Non-compliance with laws governing call/communication recording or monitoring.

Telecommunications-Specific Rules

  • Violating industry standards (e.g., CTIA guidelines) or carrier requirements.

  • Artificially inflating traffic (e.g., generating calls/messages for financial gain without legitimate purpose).

  • Misusing virtual/long numbers for automated/bulk messaging or forwarding to inactive endpoints.

  • Transmitting unauthorized caller/sender IDs or exceeding unanswered/short-duration call thresholds.

  • Using Aancall numbers with non-Aancall services without approval.

Prohibited Content

Users may not transmit, store, or distribute:

  • Fraudulent, deceptive, or misleading content (e.g., false advertising, credit card fraud).

  • Defamatory, discriminatory, obscene, or hateful material.

  • Content infringing intellectual property, privacy, or publicity rights.

  • Malware, viruses, or harmful programs.

  • Terrorism-related, illegal, or adult content (unless age-gated and legally compliant).

  • Sensitive financial/health data (e.g., HIPAA-protected info) without proper agreements.

API & Platform Restrictions

  • API Services:

    • No emergency service integration (e.g., 911, E911).

    • No reselling, sublicensing, or group messaging without written consent.

    • Avoid traffic patterns disproportionately increasing Aancall’s costs.

    • Maintain verified “Know Your Customer” (KYC) data for all Users.

    • No premium number usage or third-party charges without approval.

  • Application Services:

    • Aancall may block communications to certain regions/countries if violations are suspected.

    • Fair Usage: Unlimited plans are for standard business use (e.g., typical patterns of 95% of Users). Excludes call centers, resellers, or automated systems without live dialog (unless using Aancall-approved contact center services).

    • Usage Limits:

      • Outbound domestic calls: ≤3,000 minutes per seat/month.

      • Outbound SMS: ≤100 messages per seat/month.

      • Toll-free plans: Inbound minutes capped at 3,000/month (overages: $0.03/minute).

    • Overage Fees: Excess usage incurs charges (calls: 0.06/minute;SMS:0.06/message).

    • International Calling: Enabled only for pre-approved countries (see Annexure 1). Rates apply per destination (write to contact@aancall.com for current applicable rates). Contact sales for additional destinations.

Prohibited Activities

  • Bulk call-in lines (e.g., hotlines, 900 numbers) without Aancall contact center services.

  • Auto/predictive dialing, spam/blast messaging (>100 simultaneous voicemails).

  • Using email storage excessively or for non-communication purposes.

Enforcement

Aancall may audit accounts for compliance. Violations may result in fees, plan adjustments, suspension, or termination. Customers will receive notice to rectify misuse before charges apply.
